Mercury Broker Fee Violations
In April-May 2013, Levy was lead trial counsel in an administrative trial against Mercury Insurance Company, seeking to impose penalties against Mercury for facilitating illegal broker fees by Mercury agents. Levy represented Consumer Watchdog, which intervened in an enforcement action brought by the California Department of Insurance against Mercury for its broker fee practices. Levy and co-counsel from Consumer Watchdog took the lead in the three-week trial, presenting witnesses and exhibits to support the Department’s case to Administrative Law Judge Michael Scarlett. Judge Scarlett is expected to rule shortly, and his proposed decision for Insurance Commissioner Dave Jones will likely be public by the end of this year.
