Court Set to Rule in Favor of CashCall After 13-Day Trial
On January 20, 2022, San Mateo Superior Court Judge Marie Weiner issued a Tentative Decision returning all interest paid by class members. The Court indicated that it would offset borrower payments by the amount of the loan principal ($2,600) and the $75 loan application fee. A formal Statement of Decision is expected in the near future, with a Judgment in favor of the Class to follow.
Court of Appeal upholds $27.5 Million File Against Mercury Insurance for illegal Auto Insurance Charges
The California Court of Appeal upheld the $27.5 million fine issued by the Commissioner Insurance against Mercury's challenge to the fine in Orange County Superior Court. The fine was obtained after over six years of administrative litigation, in which Levy and Consumer Watchdog prevailed against Merucry Insurance Company for allowing Mercury agents to charge California consumers millions in illegal "broker fees" on Mercury car insurance. The appellate court reversed a lower court ruling vacating the fine and reinstated it in full.
